I am the parent/legal guardian of the Child/Children named below or I have obtained permission from the parent/legal guardian of the Child/Children named below to sign this agreement on their behalf. I give permission and accept full responsibility for the Child/Children to participate in activities, exhibits, and/or use of equipment at the Children’s Museum of South Bend. This Assumption of Risk, Waiver, and Release of Liability covers all use of the Children’s Museum of South Bend facilities, including, but not limited to, viewing and/or use of exhibits, use of any equipment, and participation in any and all activities at the Children’s Museum of South Bend.
Your presence and participation in our facility is your express agreement and consent to the terms and conditions of the Museum set forth below on behalf of both yourself and any minors in your care:
1. The activities, exhibits, and/or equipment at the Children’s Museum of South Bend require certain degree of skill, ability, and physical condition. By signing below, you expressly agree to assume all risks of injury to you, any minors in your care, your representatives, heirs, executors, administrators, agents and assigns that could arise as a result of your participation in use of the Children’s Museum of South Bend facilities, including, but not limited to, viewing and/or use of exhibits, use of any equipment, and participation in any and all activities at the Children’s Museum of South Bend. These risks could include, but are not limited to, risks of personal injury, disability or death, and risks of damage to your property.
2. Participation in use of the Children’s Museum of South Bend facilities including, but not limited to, viewing and/or use of exhibits, use of any equipment, and participation in any and all activities at the Children’s Museum of South Bend is purely voluntary, no one is forcing me, or the minors in my care to participate, and I and the minors in my care elect to participate in spite of the known and unknown risks.
3. By signing below, I agree to defend, indemnify, and hold the Children’s Museum of South Bend, their officials, officers, employees, agents and volunteers free and harmless from and against any and all claims, demands, causes of action, expenses, liabilities, losses, damages and injuries to property or persons (including myself or any and all minors in my care), including claims for wrongful death, in any manner arising out of or incident to any acts, omissions, or willful misconduct of the undersigned arising out of or in connection with the use of the Children’s Museum of South Bend facilities, including, but not limited to, viewing and/or use of exhibits, use of any equipment, and participation in any and all activities at the Children’s Museum of South Bend, including, without limitation, the payment of all damages, attorney’s fees, and other related costs and expenses.
4. The undersigned agrees on behalf of him/herself, the minors in his/her care, his/her representatives, heirs, executors, administrators, agents, and assigns to release the Children’s Museum of South Bend, and their officials, officers, employees, agents, and volunteers from any and all claims arising from any injury to person or property arising out of or in connection with the use of the Children’s Museum of South Bend’s facilities, including, but not limited to, viewing and/or use of exhibits, use of any equipment, and participation in any and all activities at the Children’s Museum of South Bend.
